General Terms
1. Agreement
These General Terms govern access to Surge Core Academy websites, learning portals, and related communications operated from Japan. By browsing or enrolling, you agree to these terms and to the policies linked in the footer.
2. Services Described
We provide professional training content, cohort sessions, mentor feedback, and downloadable materials related to information technology skills. Unless a separate order form states otherwise, services are educational and advisory—not outsourcing of production operations for your employer.
3. Eligibility and Accounts
You must provide accurate registration details and keep credentials confidential. You may not share seat access beyond the purchased allocation. We may suspend accounts that show credential sharing, abusive behavior toward staff or peers, or attempts to disrupt lab infrastructure.
4. Intellectual Property
Course materials, labs, rubrics, and branding remain our property or that of our licensors. You receive a limited, non-transferable license to use materials for personal learning during access windows. You may not resell, publicly repost, or incorporate materials into commercial training without written permission.
5. Learner Responsibilities
You agree not to upload secrets, regulated personal data, or malware to shared systems. You will follow lab safety instructions and respect other learners' privacy in breakout rooms. You acknowledge that mentor feedback is educational opinion, not a substitute for employer engineering review.
6. Liability Limits
To the fullest extent permitted under Japanese law, we are not liable for indirect, incidental, or consequential damages arising from use of materials—including lost profits, service outages at your employer, or data loss in personal environments. Our aggregate liability for any claim relating to a cohort enrollment is limited to the fees paid for that enrollment.
7. Governing Law and Disputes
These terms are governed by the laws of Japan without regard to conflict-of-law rules. Courts in Miyazaki Prefecture shall have exclusive jurisdiction, except where mandatory consumer protections assign jurisdiction elsewhere for individual consumers residing in Japan.
8. Termination and Changes
We may update these terms with a revised "last updated" date. Continued use after notice constitutes acceptance. We may terminate access for breach or for operational sunsetting of a program, with refund handling described in the Returns & Refunds policy when payments apply.
